These Terms and Conditions (“Terms”) govern your use of the services, platforms, and communications provided by Dillon Homes (“we,” “us,” or “our”). By accessing or using our Services, including engaging with us via phone, SMS/text message, chat, or any digital platform, you agree to be bound by these Terms.
 
Please read these Terms carefully. If you do not agree, please discontinue use of our Services.
 

1. Use of Services

Our Services are intended for lawful, personal, or business-related use only. You agree not to use our Services for any unlawful purpose or in any manner that could damage, disable, or impair our operations or the experience of other users.
You represent and warrant that:
– You are at least 18 years of age
– You have the authority to enter into these Terms on your own behalf or on behalf of an organization
– All information you provide to us is accurate and complete
 

2. SMS and Text Message Communications

2.1 Program Description

By providing your mobile phone number and consenting to receive text messages, you agree to receive SMS/text communications from us. These messages may include, but are not limited to:

– Appointment confirmations, reminders, and scheduling updates

– Project or service status notifications

– Follow-up messages and customer support

– General informational communications related to your inquiry or account

– SMS and MMS messages are delivered through Twilio, Inc., a registered A2P messaging provider operating in compliance with carrier and TCPA requirements.

2.2 Consent and Opt-In
Your participation in our SMS messaging program is voluntary. You provide consent to receive text messages when you:
– Submit a web form that includes your phone number and an SMS opt-in checkbox or disclosure
– Verbally or in writing request to receive text communications from us
– Text a designated keyword to our messaging number
By opting in, you confirm that you are the owner or authorized user of the mobile number provided and that you are authorized to consent to receive messages at that number.
2.3 Message Frequency
Message frequency will vary based on your interactions with us and the nature of your service engagement. You may receive multiple messages per week depending on your account activity.
2.4 Message and Data Rates
Message and data rates may apply. These charges are determined by your mobile carrier and are your sole responsibility. We are not responsible for any charges incurred through your wireless provider.
2.5 Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP to any text message sent by us. Upon receipt of your opt-out request, we will send you a single confirmation message, and no further messages will be sent to your number unless you re-enroll.
To re-enroll after opting out, you may contact us directly or follow any re-enrollment instructions provided.
2.6 Help
To receive help or more information about our SMS program, reply HELP to any text message, or contact us directly using the information provided in Section 11.
2.7 Supported Carriers
Our SMS messaging service is available on major U.S. carriers including, but not limited to, AT&T, Verizon, T-Mobile, and Sprint. Carrier support may vary.
2.8 No Guarantee of Delivery
We are not liable for undelivered, delayed, or misdirected messages due to carrier issues, technical failures, or incorrect contact information provided by the user.
 

3. Phone and Voice Communications

By providing your phone number, you consent to receive phone calls from us for purposes related to your inquiry, service request, or account. These calls may be made by our team members or through automated or AI-assisted communication systems — including our AI voice service powered by VAPI — where permitted by applicable law.
 
You may opt out of phone communications at any time by notifying us in writing or verbally during a call. Opting out of voice calls does not automatically opt you out of SMS communications, and vice versa.
 

4. Automated and AI-Assisted Communications

We may use automated systems, chatbots, or AI-assisted tools to respond to inquiries, schedule appointments, and deliver communications. This includes our optional 24/7 inbound answering service powered by VAPI, which enables fast, professional replies to new leads at any hour.

We also integrate with Google Calendar to sync appointments and manage client consultations, making bookings visible and accessible across our web and mobile applications.

By engaging with our Services, you acknowledge and consent to potential interaction with these automated systems. You will be informed at the start of any AI-assisted call or conversation. Responses generated by AI may not always be accurate or complete — for anything requiring a firm commitment or binding decision, please confirm with a human member of our team.

5. Google Account Authorization

If you choose to connect your Google account to our Services, you authorize Dillon Homes to access your Google Calendar data for the purposes of syncing appointments and managing bookings. This access is governed by Google’s Terms of Service and OAuth policies.

– You may revoke this authorization at any time through your Google Account settings.
– We will not access Google data beyond the permissions explicitly granted during the authorization flow.
– We do not use your Google data for advertising, profiling, or any purpose unrelated to appointment scheduling.
– Revoking Google access may limit certain features of our Services.

 

6. Intellectual Property

All content, materials, logos, and information provided through our Services are the property of Dillon Homes or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our prior written consent.
 

7. Disclaimer of Warranties

Our Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
 
We do not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components.
 

8. Limitation of Liability

To the fullest extent permitted by applicable law, Dillon Homes and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services or these Terms, even if advised of the possibility of such damages.
 
Our total liability to you for any claims arising out of or related to our Services shall not exceed the amount you paid to us, if any, in the three (3) months preceding the claim.
 

9. Indemnification

You agree to indemnify, defend, and hold harmless Dillon Homes and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of our Services, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
 

10. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that state.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
 

15. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or disclosures incorporated herein, constitute the entire agreement between you and Dillon Homes regarding your use of our Services and supersede any prior agreements or understandings.
